Providers like Planned Parenthood cannot claim federal funding for advocating abortion overseas

The US Supreme Court has confirmed that abortion providers like International Planned Parenthood cannot expect taxpayers to fund their advocacy of abortion overseas, the American Center for Law and Justice (ACLJ) reported last week.

In hearing the case of US Agency for International Development v. Alliance for Open Society International (AID v. AOSI II), which dealt with anti-trafficking policy, the Court also gave its support to the Mexico City Policy, which blocks the federal funding of NGOs that promote or provide abortion.

The Court ruled 5-3 in March this year that organizations like International Planned Parenthood are barred from claiming federal funding on the grounds that they are exercising a First Amendment right to Free Speech in advocating abortion overseas.

Writing for the Majority, Justice Brett Kavanaugh said: “It is a long-settled as a matter of American constitutional law that foreign citizens outside U.S. territory do not possess rights under the U.S. Constitution.”

Commenting on the case, ACLJ said in a statement: “Foreign companies working abroad cannot use the First Amendment as a weapon against the United States. And while domestic corporations do enjoy First Amendment protections, their foreign affiliates are separate entities that cannot piggyback onto the rights of U.S. corporations.”
