Supreme Court nominee says court should not try and make policy

US Supreme Court nominee Amy Coney Barrett will tell senators at her confirmation hearing that the court should leave policy-making to Congress and to Presidents, VOA News reports. The strongly conservative President Trump nominee appears before the Senate Judiciary Committee for four days of hearings starting Monday.

The Republican-controlled Senate has pushed to fast-track Barret’s confirmation following the recent death of Supreme Court Justice Ruth Bader Ginsburg, in order for the nominee to take her place on the bench before the November 3 election. Referring to what he believes may be a disputed election result, President Trump told reporters last month:  “I think this will end up in the Supreme Court and I think it’s very important that we have nine justices, and I think the system’s going to go very quickly.” 

In her opening statement to the senators, which was published in advance, Barrett said the Supreme Court is “not designed to solve every problem or right every wrong in our public life.”

On the contrary, Barrett says: “The policy decisions and value judgments of government must be made by the political branches elected by and accountable to the people. The public should not expect courts to do so, and courts should not try.”

Republican lawmakers have said they have enough votes to confirm Barrett without any vote of approval from Democratic senators.
