Trump Administration Asks Supreme Court to Override Deportation Limits to South Sudan

(Worthy News) – The Trump administration on Tuesday filed an emergency appeal with the U.S. Supreme Court seeking to overturn a lower court ruling that blocked the deportation of seven migrants to South Sudan without additional procedural safeguards.

The administration is challenging a directive by U.S. District Judge Brian Murphy, who ruled last week that officials must give meaningful notice before deporting individuals to countries that are not their country of origin. The ruling halted the removal of migrants mid-flight, forcing the U.S. to detain them at a military base in Djibouti, which the government said is ill-equipped for such detentions.

Justice Department lawyers criticized the judge’s order, calling it a “diplomatic and logistical morass” and argued it interferes with the administration’s authority over foreign policy, especially in sensitive negotiations with third-party nations willing to accept deportees with serious criminal records.

According to Trump officials, the deportees include individuals convicted of crimes such as robbery, sexual assault, and murder. The State Department had previously arranged deportations to countries including Libya, only to be blocked again by the same court.

Judge Murphy reaffirmed his position Monday, denying a government request to revisit the decision. He insisted his orders were “sensible and conservative,” designed to allow the migrants to raise objections based on fears of persecution or torture, a process known as a “reasonable fear interview.”

If credible, those fears could delay deportation by at least 15 days and potentially require the migrants to be returned to the U.S.

The case marks the latest legal clash over the administration’s effort to expedite deportations without extended judicial review.
