Trump Pursues Proof of Election Fraud in Federal Criminal Case

(Worthy News) – Former President Donald Trump’s legal team claims that he had a “good faith” basis to question the results of the 2020 election. They are now petitioning a federal court in Washington to compel federal prosecutors to provide evidence indicating the presence of election fraud in the 2020 election. The legal team contends that such evidence will be crucial for President Trump’s defense in the case.
In a pretrial motion submitted on Monday, President Trump’s legal team asserts that his concerns regarding fraud in the 2020 presidential election were “plausible and maintained in good faith.” They reference various official investigations conducted post-election, which allegedly revealed evidence of foreign influence in the electoral process.
The motion further suggests the potential involvement of foreign actors in influencing the election and contends that federal officials provided “false assurances” to the public regarding the election’s security, asserting that these assurances exceeded the government’s actual knowledge.
“It was not unreasonable at the time, and certainly not criminal, for President Trump to disagree with officials now favored by the prosecution and to rely instead on the independent judgment that the American people elected him to use while leading the country,” Trump’s lawyers said in the motion.
In this case, special counsel Jack Smith alleges that Trump disregarded officials’ findings of no widespread election fraud. Furthermore, it accuses Trump of initiating an illicit scheme to overturn the election results and impede the peaceful transfer of power.
In the most recent legal move, Trump’s legal team seeks permission to compel Mr. Smith’s team to provide extensive information that could benefit the defense. This includes details related to the “impact of foreign influence,” occurrences of “actual and attempted compromises of election infrastructure,” and evidence indicating potential “political bias” that may have influenced the intelligence community’s assessment of the election.
The motion seeks to reassess the intelligence community’s efforts in 2020 to uncover interference by nations like Russia, China, and Iran. Citing a January 7, 2021 memo from John Ratcliffe, the former Director of National Intelligence and a Trump ally, it highlights China’s alleged attempt to influence the election.
Additionally, the motion requests details from prosecutors on a 2019-2020 Russian cyberespionage campaign affecting federal agencies, contending that this intrusion casts doubt on officials’ confidence in the election’s security during that time.
Defense attorneys are also urging prosecutors to release documents related to the January 6, 2021, U.S. Capitol riot. The lawyers specifically are seeking statements from prosecutors in other riot-related cases that might challenge the Smith team’s assertion that Trump was responsible for the violence on that day.
Legal analysts have highlighted the weakness in Mr. Smith’s case, emphasizing the challenge of proving that the Former President “knowingly made false statements regarding the election beyond a reasonable doubt.”

The outcome of the 2020 election was determined by a combined total of 90,000 votes.
