Federal judge tells Flynn prosecutors to swear under penalty of perjury that documentary evidence is accurate

(Worthy News) – In an action that may delay its outcome until after the Nov. 3 election, a federal judge gave prosecutors in the case against Michael Flynn until Monday to swear under penalty of perjury that evidence they have filed is accurate, the Hill reports. Judge Emmet Sullivan issued the order after former FBI agent Peter Strzok accused the prosecution of altering documents pertaining to notes he had made.

Writing to Judge Sullivan last month, Strzok’s attorney Aitan Goelman said the DOJ had added dates to documents, and that at least one of the dates was wrong.

In response, the DOJ told the court that investigators reviewing the case had included the dates on the documents by mistake. “In response to the Court and counsel’s questions, the government has learned that, during the review of the Strzok notes, FBI agents assigned to the EDMO review placed a single yellow sticky note on each page of the Strzok notes with estimated dates (the notes themselves are undated),” DOJ attorney Jocelyn Ballantine wrote in a court filing.

“Those two sticky notes were inadvertently not removed when the notes were scanned by FBI Headquarters before they were forwarded to our office for production,” Ballantine said. “The government has also confirmed with Mr. Goelman and can represent that the content of the notes was not otherwise altered.”

Although Flynn admitted lying to the FBI while the bureau was investigating Russian interference in the 2016 election, he has since hired an attorney to fight for a dismissal of the DoJ’s case. The DoJ itself is seeking to drop the case, but Sullivan is so far still considering whether to dismiss the matter.
