SCOTUS Rejects Special Counsel’s Request to Decide Trump’s Immunity Claim, Handing Trump a Win

(Worthy News) – On Friday, the U.S. Supreme Court (SCOTUS) declined the request from special counsel Jack Smith for an expedited review concerning a defense strategy in one of the two cases he is handling against Former President Donald Trump.

The matter will continue under the jurisdiction of the D.C. Circuit Court of Appeals, where arguments on Trump’s claims of immunity from criminal prosecution are set to be heard on January 9. Initially, the appeals court declared a suspension of all other proceedings until the Supreme Court took “final action.”  SCOTUS’ refusal to intervene now permits the continuation of the appeal process.

SCOTUS may still address the issue later, though not with the urgency that Mr. Smith needed to accelerate the trial proceedings before the November presidential election.

Earlier this week, Trump’s legal team advised SCOTUS not to hasten its decision on this unprecedented case, which questions whether a president can face criminal charges for official acts, cautioning against a rushed judgment influenced by “partisan motivation.”

President Trump’s legal team contends that all actions he is charged with were executed in his capacity as President of the United States, and the argument of their defense is based on the claim that these actions are protected by “presidential immunity.”

While SCOTUS has established absolute immunity for presidents from civil lawsuits, defense attorneys have argued that subjecting presidents to criminal prosecution for actions taken while in office could have far-reaching consequences.  However, prosecutors have countered, asserting that presidential immunity is irrelevant in this context, as they are charging President Trump for offenses allegedly committed during his tenure in office, which they argue falls outside the scope of such immunity claims.

Considering the Presidential election set for November 2024, any delays in the legal process might politically benefit Trump. In this context, SCOTUS’ decision today can be seen as a victory for Trump.
